What Is a Contested Divorce?

A contested divorce occurs when spouses cannot reach a mutual agreement on the terms of their divorce. This can involve disagreements over various issues such as child custody, child support, property division, and spousal support. Unlike an uncontested divorce, a contested divorce requires legal representation and court proceedings to resolve the disputes.

In Alabama, filing a contested divorce involves the following steps: 

  • Filing an initial complaint. One spouse will file a complaint that names their attorney, establishes the grounds for divorce, and outlines your desired terms. The filing party will need to have the complaint served to their spouse. 
  • Receiving the response to the complaint. Once received, the other party has 30 days to respond to the complaint with their counter terms and conditions. 
  • Obtaining documents in discovery. Each party will work with their attorney to collect evidence and ask the other side to provide information and documents. Attorneys can file motions and conduct depositions to support your position. 
  • Negotiating the terms. Spouses can work to negotiate a settlement, and in some cases, the court can require you to complete mediation before the case goes to trial (see the Alabama Mandatory Mediation Act). 
  • Going to trial. The court will make final determinations on the terms of your divorce. Either party can file an appeal or Motion to Alter within a month of the ruling. However, if neither party wishes to contest the court’s decision, the contested divorce process concludes. 

Alabama Residency Requirements 

It is important to note that: In order to file for divorce in Alabama, you must meet the residency requirements. As outlined in Ala. Code § 30-2-5, if the defendant (i.e., the party being served divorce papers) is not a resident of Alabama, the plaintiff must have been a resident for at least six months before filing for divorce. 

Are All Decisions Left to the Court in a Contested Divorce? 

Not necessarily. In some cases, parties may be able to reach agreements on certain issues through negotiation or mediation. However, the court has the final say. 

For instance, you may have agreed on terms for alimony. The court will review the agreement to ensure the terms are fair to both parties and will make determinations concerning the other aspects of your divorce based on the evidence and information presented by each side.
