Child Custody vs. Visitation: Understanding Key Differences

There are two primary types of custody: physical custody and legal custody. Physical custody involves the right to have the child live with you. Legal custody involves the right to make important decisions about the child's life.

Unlike child custody, visitation only allows a non-custodial party to spend time with a child. Visitation can be either supervised or unsupervised. Supervised visitation means that a third party, such as a family member, friend, or professional, is present during the visits. 

Supervision is often required in cases where there are concerns about the safety or well-being of the child. Unsupervised visitation allows the non-custodial parent to spend time with the child without the presence of a third party.

It is important to note that while visitation allows a non-custodial parent to maintain a relationship with their child, they do not have the same legal standing as the custodial parent when it comes to making decisions about the child's upbringing. 

Grandparents’ Visitation Rights in Alabama

Parents have the legal right to restrict grandparents’ access to their children. However, the grandparents can seek legal intervention and file for visitation.

Under Ala. Code § 30-3-4.2, grandparents can only pursue visitation rights in the following instances: 

  • The child’s parents have filed for divorce or separation. 
  • One of the child’s parents has died. 
  • The child was born out of wedlock, and the petitioner is the child’s maternal or paternal grandparents when paternity has been legally established. 
  • The child’s parents have lost parental rights or are involved in a case where their parental rights may be terminated. 

Grandparents can also file a rebuttal against visitation denial if a legally fit parent restricts their visitation rights. To do so, they will need to prove that they have an established relationship with the child and that visitation is in the best interest of the child.
