When Can an Alabama Family Court Order Be Modified?
Family orders can be modified if either party can prove there has been a material change in circumstances that affect the original terms of the order. This change can be in the child’s educational or medical needs, either parent’s income, either party’s relocation, or other circumstances related to the child or parents. With child custody modification, the petitioner will need to prove the modifications are in the best interest of the child.
Family court orders can also be modified as an enforcement action. For instance, if a parent withholds visitation, the court may penalize them by modifying their visitation terms to accommodate the other party.
Actions That Can Lead to Enforcement Cases
Enforcement actions in family law and divorce matters are initiated when one party fails to comply with the terms of a court order. These actions can be initiated by either party or, in some cases, by the court itself. The goal of enforcement actions is to ensure that the terms of the court order are carried out.
Some common reasons for enforcing divorce and family law orders include but are not limited to the following:
- Failure to pay child support. When a parent fails to make timely child support payments, it can lead to financial hardship for the custodial parent and their children.
- Withholding visitation. Denying a parent their scheduled visitation time can have a negative impact on a child's emotional well-being and their relationship with both parents.
- Disobeying custody orders. If a parent violates custody orders by taking the child outside the agreed-upon jurisdiction or failing to return the child at the designated time, it can disrupt the child's routine and cause emotional distress.
- Refusing to provide medical insurance. When a parent fails to maintain medical insurance coverage for their child, it can put the child's health at risk and lead to significant financial burdens.
- Interfering with parenting time. A parent may engage in behaviors that interfere with the other parent's parenting time, such as making false accusations or trying to alienate the child.
